Frequently Asked Questions

Common questions about late and revised ITR filing

What is the last date to file a belated return for FY 2024-25?
The last date to file a belated income tax return for Financial Year 2024-25 (Assessment Year 2025-26) is December 31, 2025, under Section 139(4). After this date, you cannot file for that year unless the Income Tax Department issues a notice under Section 142(1) or 148. Filing by December 31 also avoids the additional ₹5,000 penalty under Section 234F (reduced to ₹1,000 if income is below ₹5 lakhs).
What penalty applies for filing ITR late?
Under Section 234F, a late filing fee of ₹5,000 applies if the return is filed after the due date (July 31 for individuals). However, if your total income does not exceed ₹5,00,000, the late fee is capped at ₹1,000. Additionally, interest under Section 234A at 1% per month (or part of month) is charged on the outstanding tax amount from the due date until the date of filing. Section 234B and 234C interest also apply if advance tax was not paid properly.
Can I revise my return after filing?
Yes. Under Section 139(5), you can file a revised return to correct any omission or wrong statement in your original return. The revised return must be filed before December 31 of the assessment year or before the completion of assessment, whichever is earlier. There is no limit on the number of revisions. Importantly, there is no penalty for revising a correctly filed return — revisions are a normal part of the filing process.
What losses can I not carry forward if I file late?
If you file a belated return (after the original due date), you LOSE the right to carry forward losses under: Business losses (Section 72), Speculation business losses (Section 73), Capital losses other than LTCL from house property (Section 74), and Losses from owning and maintaining racehorses. However, House Property Loss up to ₹2 lakhs and unabsorbed depreciation CAN be carried forward even in belated returns. This is a significant reason to file on time, especially for business owners and investors.
I received a notice for not filing. What should I do?
If you received a notice under Section 142(1) for non-filing, or a communication asking why you haven't filed, respond promptly via the e-filing portal. The usual course of action is to file the pending return immediately and submit a response through the compliance portal with the acknowledgment number. Ignoring such notices can lead to best judgment assessments under Section 144, where the assessing officer estimates your income (often unfavorably). We handle notice responses and late filings together.
